The information you submit to the Listing Generator is transmitted to an artificial intelligence service provider for processing. Where OpenAI's API is used, API inputs and outputs are not used to train OpenAI models by default. OpenAI may retain limited API data for abuse monitoring and security for a limited period in accordance with its applicable data controls and contractual terms.

4. Our lawful bases for using personal information
Under UK data protection law, we must have a lawful basis for each purpose for which we use personal information. Depending on the circumstances, we may rely on the following:
Contract
Where processing is necessary to provide something you have purchased or requested, such as course access, membership, the Listing Generator, affiliate participation, customer support or another service.
Consent
Where you have specifically agreed to receive marketing communications, or where consent is required for non-essential cookies or similar technologies. You can withdraw consent at any time.
Legitimate interests
Where processing is reasonably necessary for the operation, administration, improvement or protection of POD Launch Pro, provided that your rights and interests do not override those interests. Examples may include preventing fraud, maintaining service security, handling routine enquiries, keeping appropriate business records and improving our services.
Legal obligation
Where we need to process or retain information to comply with applicable law, including accounting, taxation, regulatory and legal requirements.
5. Marketing communications
We may send you marketing communications where we have consent or another lawful basis permitted by UK law. Where the Privacy and Electronic Communications Regulations allow it, we may also contact existing customers about similar products or services, provided that an appropriate opt-out is offered.
You can stop receiving marketing emails at any time by using the unsubscribe link in the email or by contacting support@podlaunchpro.com. Opting out of marketing does not prevent us from sending necessary service messages about your account, purchase, membership or transaction.
6. Cookies and similar technologies
Our website and the services we use may use cookies and similar technologies. Some are necessary for functions such as login, checkout, security and membership access. Others may be used for analytics, advertising or measuring website use.
Where UK law requires consent, we seek consent before using non-essential cookies or similar technologies. You can also control cookies through your browser settings and, where available, through the cookie controls shown on our website.
7. Who we share information with
We use trusted service providers to run POD Launch Pro. Depending on the service you use, personal information may be processed by providers involved in:
· Website, funnel and membership services, including Systeme.io.
· Application hosting and technical infrastructure, including Vercel and related cloud services.
· Artificial intelligence processing, including OpenAI where used by the Listing Generator.
· Payment processing.
· Email delivery and customer communications.
· Video conferencing and webinar delivery, including Zoom where used.
· Database, security, analytics and technical support services.
We share only the information reasonably necessary for those providers to perform their services. We may also disclose personal information where required by law, regulation, court order or another lawful authority.
8. International transfers
Some of our service providers may process personal information outside the United Kingdom. Where personal information is transferred internationally, we take reasonable steps to ensure that the transfer is lawful and that appropriate safeguards are used where required. These may include UK adequacy regulations, the UK International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses, or another lawful transfer mechanism.
9. How long we keep your information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including to provide services, administer memberships and affiliates, resolve disputes, maintain appropriate records and meet legal obligations.
· Membership and account information is generally kept while your membership or account is active and afterwards for as long as needed to deal with renewals, support, disputes or legal obligations.
· Support and correspondence records are kept for as long as reasonably necessary to deal with the matter and maintain an appropriate business record.
· Marketing information is kept until you unsubscribe, we no longer have a lawful basis to use it, or we determine that it is no longer needed.
· Affiliate and referral records are kept for as long as needed to administer referrals, commissions, disputes, tax and accounting requirements.
· Financial and transaction information is kept for the period required by applicable tax, accounting and legal obligations.
· Product photographs uploaded to the Listing Generator are processed temporarily and are not retained by the Listing Generator application after generation.
We review the information we hold and delete or anonymise it when it is no longer required.
10. How we protect your information
We take reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse, alteration or disclosure. Measures may include access controls, account authentication, encryption provided by our service providers, secure connections and use of reputable hosting and payment services.
No internet-based service can be guaranteed to be completely secure, but we take reasonable steps to protect the information entrusted to us.
11. Automated decision-making and AI
The Listing Generator uses artificial intelligence to generate suggested Etsy listing content from information and images supplied by the member. It does not make decisions about you that have legal or similarly significant effects. We do not use solely automated decision-making with legal or similarly significant effects on individuals.
12. Your data protection rights
Depending on the circumstances, UK data protection law gives you rights in relation to your personal information. These may include the right to:
· Ask whether we are processing your personal information and request a copy of it.
· Ask us to correct inaccurate or incomplete personal information.
· Ask us to erase personal information in certain circumstances.
· Ask us to restrict processing in certain circumstances.
· Object to certain processing, including direct marketing.
· Receive certain personal information in a portable format where the right to data portability applies.
· Withdraw consent at any time where we rely on consent.
These rights are not absolute and may depend on the circumstances and the lawful basis for processing. To exercise a right, contact support@podlaunchpro.com.
13. Complaints
If you have concerns about how we use your personal information, please contact us first at support@podlaunchpro.com so that we have the opportunity to address the issue.
You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data protection regulator. Information about making a complaint is available on the ICO website.
14. Third-party websites
Our website, emails or member resources may contain links to websites and services operated by other organisations. We are not responsible for the privacy practices of those third parties. We recommend reviewing their privacy information before providing personal data.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our services, service providers, technology or legal requirements. The latest version will be published on the POD Launch Pro website and the date at the top of the policy will show when it was most recently updated.
