POD Launch Pro Terms and Conditions

These Terms and Conditions apply to products, courses, memberships and services provided by Nigel Wymer, trading as POD Launch Pro
These Terms and Conditions govern your use of the POD Launch Pro website, paid courses, memberships, member resources, live training, support services, AI-powered Etsy Listing Generator and any other services that refer to these Terms. Please read them before purchasing or using a paid service.
Nothing in these Terms is intended to exclude or restrict any rights that cannot lawfully be excluded, including statutory consumer rights where they apply.
1. About these Terms
By purchasing, registering for, accessing or using a POD Launch Pro paid service, you agree to these Terms and to any specific information shown on the relevant sales page or checkout. If there is a direct conflict, the specific terms clearly shown at checkout for that purchase will take priority for matters such as price, payment frequency and access period.
You must be at least 18 years old to purchase a paid POD Launch Pro service. If you purchase on behalf of a business or organisation, you confirm that you have authority to bind that business or organisation.
2. What POD Launch Pro provides
Depending on the offer you purchase, POD Launch Pro may provide some or all of the following:
· Online print-on-demand courses and recorded training.
· Time-limited or ongoing membership access.
· Live online training sessions, Q&A sessions and shop or listing reviews.
· Email or other member support.
· Downloadable or online resources, guides, templates and replay libraries.
· Access to the members-only AI-powered Etsy Listing Generator.
· Other bonuses, tools or resources described on the relevant sales page.
The exact contents of your purchase are those described on the sales page and checkout at the time you buy. We may improve, replace or update individual resources during a membership period provided that the overall service remains materially consistent with what was purchased.
3. Orders and formation of the contract
When you submit an order and payment, you are making an offer to purchase the service shown at checkout. A contract is formed when payment is accepted and we send or display confirmation, or when we make the purchased service available to you, whichever happens first.
We may refuse or cancel an order before access is provided where there is an obvious pricing or technical error, suspected fraud, misuse, duplicate transaction or another legitimate reason. If we cancel an order after taking payment and no service has been supplied, we will refund the amount paid.
4. Prices and payment
Prices are shown on the relevant sales page or checkout and are normally stated in pounds sterling (GBP) unless another currency is expressly shown. The amount displayed at checkout is the amount payable to POD Launch Pro for that order, subject to any card-issuer or payment-provider currency conversion charges that are outside our control.
Payments are processed by third-party payment providers. We do not normally receive or store your full payment-card details.
If a payment is reversed, charged back, fails or remains unpaid, we may suspend the related access while the payment issue is resolved.
5. Membership duration and renewal
Annual or 12-month membership
Where an offer is described as a 12-month or annual membership paid by one payment, that payment provides access for 12 months from the applicable start date. Unless the checkout expressly states that the plan renews automatically, a one-payment annual membership does not automatically renew. Continued access after the 12-month period requires a new renewal purchase or other renewal arrangement offered by POD Launch Pro.
Monthly membership, where offered
If you purchase a monthly recurring membership, the recurring price and billing frequency will be shown before payment. The subscription continues and the payment method is charged at the stated interval until cancelled. You may cancel using the cancellation method made available with the subscription or by contacting support@podlaunchpro.com. Unless the law or the checkout terms require otherwise, cancellation stops future recurring charges and access continues until the end of the period already paid for.
If the price, billing frequency or renewal terms of an existing recurring plan are to change, we will provide any notice required by applicable law before the change takes effect.
6. Cooling-off rights, cancellation and refunds
Your cancellation and refund rights depend on the nature of the purchase, whether you are acting as a consumer or for business purposes, your location and whether supply of digital content or services has already begun.
UK consumers
If you are a UK consumer purchasing at a distance, you may have a statutory 14-day cancellation period. Because POD Launch Pro memberships may include both digital content and services that are made available immediately, we may ask you to expressly request or consent to supply beginning during that cancellation period.
Where you expressly request a service to begin during the cancellation period and then exercise a statutory right to cancel, we may be entitled to charge a proportionate amount for services supplied before cancellation. Where digital content is supplied immediately, your statutory right to cancel that digital-content supply may be affected once supply begins if the legally required express consent and acknowledgement have been obtained. Where required, any such consent or acknowledgement will be requested separately as part of the purchase process.
Nothing in these Terms removes your statutory remedies if digital content is faulty, not as described, or if a service is not provided with the standard required by law.
Business purchases and non-UK customers
If you purchase wholly or mainly for your trade, business, craft or profession, statutory consumer cancellation rights may not apply. Customers outside the UK may have mandatory rights under the law of their own country or state. Nothing in these Terms removes rights that cannot lawfully be excluded.
After any applicable cancellation period
Except where required by law or expressly stated otherwise on the relevant offer, fees are not refundable simply because you change your mind, do not use the service, do not attend live sessions or do not achieve a particular business result.
To request a cancellation or discuss a refund, contact support@podlaunchpro.com and include the email address used for purchase.
7. Access, accounts and passwords
Access is personal to the person or business that purchased the service unless we expressly agree otherwise. You are responsible for keeping login details secure and for activity carried out through your account.
· Do not share your account, password or member-only access with another person.
· Do not attempt to bypass access controls, usage limits or security measures.
· Tell us promptly if you believe your account has been accessed without permission.
· Use the same purchase email address where a service requires access to be matched to your membership.
We may require a password reset or other reasonable security step where we believe an account may have been compromised.
8. Live training, Q&A and shop reviews
Live sessions are scheduled in good faith, but dates, times, presenters or formats may occasionally need to change. Where practicable, we will provide reasonable notice of material changes. A replay may be provided where stated, but we do not guarantee that every live session will be recorded or made available indefinitely.
Any review of an Etsy shop, listing, design, advertising or business strategy is educational feedback based on the information available at the time. It is not a guarantee of sales, ranking, approval or commercial success.
Where a live session is recorded, participants will be informed or the recording will be otherwise made clear. If you do not want your image or voice included, you should keep your camera and microphone off and avoid sharing personal information in any chat or contribution that may form part of the recording.
9. Email and member support
Where support is included, it is intended to provide reasonable guidance about the course, membership and related print-on-demand topics. Unless a specific response time is expressly promised, support is not a guaranteed instant or 24-hour service. Complex questions may be better handled during a live Q&A or through another appropriate channel.
Support does not include bespoke legal, tax, accounting, financial, intellectual-property or regulated professional advice.
10. AI-powered Etsy Listing Generator
Members with access to the Listing Generator may upload product images and information to generate suggested Etsy listing content. The generator is an assistance tool and does not replace your own review or judgement.
· You are responsible for checking every generated title, description, tag, attribute suggestion and alt-text suggestion before using it.
· You must ensure that product claims, personalisation details, materials, sizes, safety information and other factual statements are accurate.
· You are responsible for complying with Etsy rules, intellectual-property law, advertising rules and any other requirements that apply to your listing or product.
· Generated text may contain errors, omissions or wording that is unsuitable for your product and may not be unique.
· No search ranking, traffic, conversion rate or sales result is guaranteed.
· Usage may be subject to limits displayed within the app or membership area. Reasonable limits may be changed to manage capacity, cost, security or fair use.
· The generator may occasionally be unavailable because of maintenance, hosting issues or third-party AI/API outages.
You must only upload images and information that you own, are authorised to use, or are otherwise legally entitled to submit for processing. Do not upload unlawful material or unnecessary confidential, sensitive or third-party personal information.
You retain your rights in the product images and information you submit. You may use listing text generated for your own products and business. We do not guarantee exclusivity of AI-generated wording or that similar wording will not be generated for another user.
11. Intellectual Property
Unless expressly stated otherwise, POD Launch Pro course videos, training materials, worksheets, guides, workflows, templates, replays, branding, website content and member resources are owned by or licensed to Nigel Wymer trading as POD Launch Pro and are protected by applicable intellectual-property laws.
Your purchase gives you a limited, non-exclusive, non-transferable right to access and use the purchased materials for your own learning and your own print-on-demand or ecommerce business during the applicable access period.
You must not, without prior written permission:
· Share, resell, sublicense, publish or distribute member-only materials or login access.
· Copy substantial parts of the training for use in another course, membership, coaching programme, prompt library or commercial resource.
· Record, reproduce or redistribute live sessions or replays except where we expressly permit it.
· Remove copyright, branding or ownership notices from supplied materials.
· Use automated scraping, extraction or similar methods to copy the website, member area or Listing Generator.
You may apply the ideas, methods and know-how you learn to your own business, and you may use Listing Generator outputs created for your own products, subject to these Terms and any third-party rights.
12. Third-party platforms and services
POD Launch Pro may teach, demonstrate, link to or integrate with third-party services such as Etsy, print-on-demand suppliers, design platforms, Systeme.io, Zoom, Vercel, OpenAI, payment providers and other software or marketplaces.
Those third parties operate independently and have their own terms, policies, pricing and technical availability. POD Launch Pro does not control and cannot guarantee the continued availability, functionality, policies, search algorithms or commercial decisions of a third-party platform.
References to third-party brands are for identification or educational purposes and do not imply endorsement, sponsorship or affiliation unless expressly stated.
13. Your responsibilities
You agree to use POD Launch Pro services lawfully and responsibly. In particular, you must not:
· Use the services to infringe intellectual-property, privacy or other rights.
· Upload malicious code or attempt to disrupt, probe or compromise the website, app, database or accounts.
· Misrepresent your identity or payment status.
· Use the services to create or promote unlawful products, fraudulent claims or prohibited activity.
· Harass, threaten or abuse other members, presenters, contractors or support staff.
· Use another member’s account or allow another person to use yours in breach of these Terms.
14. No guarantee of income or business results
POD Launch Pro provides education, tools and support. Print-on-demand and ecommerce results vary significantly between individuals and businesses. We do not guarantee that you will make sales, profit, recover the cost of membership, achieve a particular Etsy ranking, obtain marketplace approval or reach any specific financial result.
Examples, case studies, demonstrations and results discussed in training are illustrative and should not be treated as a promise that you will achieve the same outcome. You remain responsible for your own products, designs, pricing, taxes, advertising, legal compliance and business decisions.
15. Suspension and termination
We may suspend or terminate access where reasonably necessary because of non-payment, fraud, account sharing, security risk, unlawful activity, serious or repeated breach of these Terms, abuse of staff or members, or misuse of the Listing Generator or other services.
Where appropriate, we will try to give notice and an opportunity to resolve the issue before permanent termination. We may act immediately where necessary to protect users, systems, intellectual property or the business.
Suspension or termination does not affect rights or liabilities that arose before termination and does not remove any statutory rights that cannot lawfully be excluded.
16. Availability and events outside our control
We aim to keep online services reasonably available but do not promise uninterrupted or error-free access. Temporary disruption may occur because of maintenance, software updates, internet or hosting failures, third-party outages, cyber incidents or events outside our reasonable control.
We will take reasonable steps to restore affected services. Where a material paid service is unavailable for a significant period because of our own failure, we will consider an appropriate remedy having regard to the circumstances and any rights required by law.
17. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
If you are a consumer
If you are legally acting as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable. Nothing in this section affects your statutory consumer rights.
If you are acting in business
If you purchase or use POD Launch Pro wholly or mainly for business purposes, to the fullest extent permitted by law we will not be liable for indirect or consequential loss, loss of profits, revenue, sales, business opportunity, anticipated savings, goodwill or business data arising from the use of the services.
Subject to liabilities that cannot lawfully be limited, our total aggregate liability arising out of or in connection with a paid service will not exceed the total amount you paid to POD Launch Pro for that service during the 12 months immediately preceding the event giving rise to the claim.
18. Privacy and personal information
Our use of personal information is described in the POD Launch Pro Privacy Policy available on our website. By using services that require personal information, you acknowledge that the information will be handled as described in that policy and in accordance with applicable data-protection law.
19. Affiliate programme
Where POD Launch Pro operates an affiliate or partner programme, participation is subject to the commission rate, eligible products, tracking rules, payment terms and other conditions communicated when the affiliate joins or in any separate affiliate terms. Registration as an affiliate does not give an automatic entitlement to commission on every POD Launch Pro product, renewal or future purchase.
20. Changes to services and these Terms
We may update these Terms from time to time to reflect changes in the law, our services, technology or business operations. The latest version will be published on the website with an updated date.
If a change materially affects an active paid membership, we will take reasonable steps to notify affected members where required. We will not use a later change to remove rights that had already accrued under an existing purchase where doing so would be unlawful.
21. General provisions
Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
No waiver
If we do not enforce a provision immediately, that does not mean we waive the right to enforce it later.
Transfer
You may not transfer your membership, account or rights under these Terms to another person without our written agreement. We may transfer our rights and obligations as part of a legitimate business transfer, provided that this does not reduce any rights that cannot lawfully be reduced.
22. Governing law and disputes
These Terms are governed by the laws of England and Wales, subject to any mandatory rights you have under the law of the country in which you live.
If you are a consumer resident in the UK, you may bring proceedings in the courts available to you under applicable law. If you are acting wholly or mainly for business purposes, the courts of England and Wales will have exclusive jurisdiction, except where the parties agree otherwise in writing.
